Report a concern about the CFMEU
On 23 August 2024, the Construction and General Division of the Construction, Forestry and Maritime Employees Union (CFMEU) and its Divisional branches were placed under administration for a period of up to 5 years, in accordance with the Fair Work (Registered Organisations) Amendment (Administration) Act 2024 (the Administration Act). Mark Irving KC has been appointed as administrator.
The scheme of the administration (scheme) is contained in the Fair Work (Registered Organisations) (CFMEU Construction and General Division Administration) Determination 2024. The Administrator’s powers and responsibilities under the scheme are aimed at ensuring that the Construction and General Division and its Divisional branches return to a position where they are democratically controlled and operate effectively and lawfully in the interests of members.
Our General Manager is the independent statutory regulator of federally registered organisations under the Fair Work (Registered Organisations) Act 2009. This includes unions and employer associations.
It is our General Manager's role to promote the efficient management of unions and employer associations and high standards of accountability of these organisations and their office holders to their members.

Anti-avoidance provisions
The Administration Act introduced new anti-avoidance provisions that prohibit conduct, or involvement in conduct, that prevents the Administrator from effectively administering the scheme or prevents other persons or bodies from taking action under the scheme.
Our General Manager can investigate and bring civil proceedings in relation to alleged non-compliance with the anti-avoidance provisions. The Administrator also has power to bring civil proceedings in relation to alleged contraventions of the anti-avoidance provisions, and such contraventions may also be criminal offences which are a matter for the police.
