The key outcome of the Modern Awards Review 2023-24 is that we will start a number of cases on the Commission's own initiative to deal with the priority matters identified in the report.
The final report identified 6 priority awards or areas:
- Amusement, Events and Recreation Award 2020 – this case will examine the classification structure and other terms, including whether the award clearly and adequately establishes minimum terms of employment for ‘arts workers’.
- Live Performance Award 2020 – this case will address deficiencies and errors identified by parties during the Modern Awards Review 2023-24.
- General Retail Industry Award 2020 – (AM2024/33) this case will consider proposals advanced in the ‘making awards easier to use’ stream with respect to the Retail Award.
- Clerks – Private Sector Award 2020 – (AM2024/34) this case will develop a ‘working from home’ term which may serve as a model term for other awards.
- Higher Education Industry – Academic Staff – Award 2020 and Higher Education Industry – General Staff – Award 2020 – this case will review the fixed-term contract provisions in both modern awards, responding to recent changes in the Fair Work Act 2009.
- Part-time employment – this case will review award provisions that regulate part-time employment, focusing on the 7 awards identified in the making awards easier to use stream.
These cases will start in August 2024 or September 2024. The part-time case will start in 2025.
