Introduction
Ms Chantelle Zentveld, represented by the Shop, Distributive and Allied Employees Association, filed an application (AG2022/142) in the Fair Work Commission to terminate the IPCA (VIC, ACT & NT) Enterprise Agreement 2011 (AG2011/7098). The application was made under section 225 of the Fair Work Act 2009.
If the application to terminate the Agreement was granted, the Agreement would cease to apply and the wages and conditions of the employees covered by the Agreement would likely be governed by the Fast Food Industry Award 2010.
In a decision [2022] FWCA 1941 issued on 15 June 2022 the Commission terminated the agreement, effective from 13 July 2022.
