STATEMENT
[1] On 27 April 2010 we issued a statement and directions for the filing of material by all parties. 1 On 17 August 2010 we issued a further statement including fresh directions for the filing of material by parties other than the applicants.2 As indicated in the later statement the fresh directions were made primarily to permit the Australian Government (Government) adequate time to prepare and lodge its submissions. The applicant unions and the Australian Council of Trade Unions have submitted that the Government should file its submissions by 8 October 2010. The Department of Education, Employment and Workplace Relations has now requested that the Government not be required to file its submissions until 14 October 2010. In the circumstances we think it is desirable to grant the Government’s request. We now issue further directions, replacing those made on 17 August 2010.
[2] The Bench has allocated 5 to 8 and 25 to 29 October 2010 for the hearing of this matter. It seems to be common ground that the dates of 5 to 8 October 2010 should be vacated. In light of the further directions we now make, it may be that the dates of 25 to 29 October 2010 should be vacated also.
[3] We indicate now that the Full Bench will not sit on 5 to 8 October 2010. We shall not make a final decision on the 25 to 29 October dates until we have given the parties an opportunity to make submissions concerning the number of sitting days likely to be required, their availability and other relevant matters. There will be a directions hearing at 10 am on Friday 24 September 2010 at which parties should address all relevant matters.
DIRECTIONS
Further to the directions made on 17 August 2010, we now direct that:
(a) the Australian Government, the Australian Council of Trade Unions and any other party supporting the application file in Fair Work Australia:
(i) an outline of their contentions;
(ii) statements of evidence; and
(iii) any other material on which they will
seek to rely
by 14 October 2010;
(b) all remaining parties file in Fair Work Australia:
(i) an outline of their contentions;
(ii) statements of evidence; and
(iii) any other material on which they will
seek to rely
by 21 October 2010; and
(c) the applicants file any statements of evidence in reply or any other material in reply in Fair Work Australia by 28 October 2010.
