4 yearly review of modern awards – Journalists Published Media Award 2010 – modern award varied – correction.

A. The determination issued by the Full Bench on 30 April 2020 [PR718531] is corrected as follows:

1. By deleting the rates “1,301.90” and “34.26” appearing in clause 14.1 of the attachment to the determination, for a Band 2, Level 10 employee and inserting “1,383.30” and “36.40”, respectively.

2. By deleting the reference to “clause 2” in clause 16.2(b) of the attachment to the determination and inserting “clause 2—Definitions”.

3. By deleting the words “additional rates” appearing in clause 19.3 of the attachment to the determination and inserting the words “shift penalty rates”.

4. By deleting the number “110%” appearing in clause 19.4(a) of the attachment to the determination and inserting the words “an additional 10%”.

5. By deleting the word “penalty” appearing in the heading of clauses A.1.3, A.2.1 and A.3.1 of the attachment to the determination and inserting the words “public holiday”.

6. By inserting the words “, see clause 4.9(a)” after the word “employees” at footnote 1 appearing under the table at clause A.1.4 of the attachment to the determination.

7. By inserting the word “employees” after the word “newspaper” at footnote 2 appearing under the table at clause A.1.4 of the attachment to the determination.

8. By inserting the words “, see clause 4.9(a)” after the word “employees” at footnote 3 appearing under the table at clause A.1.4 of the attachment to the determination.

9. By deleting the heading of clauses A.1.5 and A.2.2 of the attachment to the determination and inserting “Metropolitan daily newspaper, magazine or wire service employees—penalty rates”.

10. By deleting the heading of clause A.3.3 of the attachment to the determination and inserting the words “All publications—cadets—other than shiftworkers—penalty rates”.

11. By deleting the heading of clause A.3.4 of the attachment to the determination and inserting “Metropolitan daily newspaper, suburban newspaper, magazine or wire service—cadets—shiftworkers—penalty rates”.

12. By deleting the heading of clause A.3.5 of the attachment to the determination and inserting “Regional daily and country non-daily newspaper—cadets—shiftworkers—penalty rates”.

13. By deleting the words “The penalty rate is capped in accordance with clause 19.5” and inserting the words “The rate for certain employees is limited in accordance with clause 19.5.” wherever it appears in Schedule A of the attachment to the determination.

14. By deleting the words “Employees exempt in accordance with clause 4.9(a)” and inserting the words “Certain employees are not entitled to penalty rates, see clause 4.9(a)” wherever it appears in Schedule A of the attachment to the determination.

15. By updating the table of contents and cross references accordingly.

B. This determination comes into operation from 18 June 2020. In accordance with s.165(3) of the Fair Work Act 2009, this determination does not take effect until the start of the first full pay period that starts on or after 18 June 2020.
